What Is A Non-Alcohol DUI?

Driving under the influence (“DUI”) of any substance that impairs your ability to drive is against the law. Police in the area are trained in drug recognition and are called out to field test for controlled substances such as THC metabolites in nonalcohol-related DUIs. Additionally, Pennsylvania’s zero tolerance laws impose steep penalties for those convicted of DUI — including impairment due to marijuana, prescription drugs or alcohol — who are under 21 years old. For a first-time offender, the penalties include license suspension for one year, jail term and fines up to $5,000.

Being Cooperative During A Non-Alcohol DUI Stop Is In Your Best Interest

While you do not have to give police permission to search your car during an initial stop, it is in your best interest to be polite and to refrain from arguing with the arresting officer. If the police think you are under the influence of marijuana or another substance, they will ask you to get out of your car to test your functioning ability in a field sobriety test.

There is no penalty to refuse the field sobriety test, and you may politely refuse to take it. However, if you are arrested and asked to take a blood, urine or breath test, it is your best interest to take the chemical test. Under Pennsylvania’s “implied consent” laws, your driver’s license will be suspended for up to a year if you do not take the test.

It is important to note that if you answer questions the police ask you during the arrest, the information you provide can be used against you in court.
